Welcome to Emotionally Moisturized. These Terms of Service (“Terms”) are a legal agreement between you and Emotionally Moisturized (“we,” “us,” or “our”) governing your use of emotionallymoisturized.com and our guides, courses, tools, and memberships (the “Services”). By accessing or using the Services, you agree to these Terms. If you don’t agree, please don’t use the Services.

Not medical advice. Emotionally Moisturized provides educational and wellness content only. It is not medical, psychological, nutritional, or professional healthcare advice, and it is not a substitute for care from a qualified professional. Always consult your physician or a qualified provider before making changes to your diet, exercise, medication, or health routine — especially regarding ADHD, perimenopause, GLP-1 medications, or eating concerns. Never disregard or delay professional advice because of something you read here. If you may be experiencing a medical or mental-health emergency, call your local emergency number.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements.

2. Your account

Some features require an account. You agree to provide accurate information, keep your login credentials confidential, and be responsible for all activity under your account. Tell us promptly at emotionally.moisturized@gmail.com if you suspect unauthorized use. You may not share paid access with others.

3. Memberships and subscriptions

  • Billing. Paid memberships are billed in advance on a recurring basis (for example, monthly or annually) through our payment processor, Stripe, at the price and interval shown at checkout.
  • Auto-renewal. Subscriptions renew automatically at the end of each billing period until you cancel. By subscribing, you authorize recurring charges to your payment method.
  • Cancellation. You can cancel anytime through your account or billing portal. Cancellation stops future renewals; it takes effect at the end of the current paid period, and you keep access until then.
  • Price changes. We may change subscription prices. We’ll give you advance notice, and changes apply to the next billing period after the notice.
  • Failed payments. If a charge fails, we may retry and may suspend or cancel access until payment is resolved.

4. Purchases and digital products

We also sell one-time digital products such as guides and courses. Prices are shown at checkout and may change over time. Once purchased, digital products are made available to you as described at the time of sale. You’re responsible for any taxes shown at checkout.

5. Refunds

Because our products are digital and delivered immediately, all sales are generally final and non-refundable, except where required by law or expressly stated at the time of purchase. If you believe there’s been a billing error or a problem with your purchase, contact us at emotionally.moisturized@gmail.com and we’ll work with you in good faith.

6. Access and license

All content in the Services — including guides, courses, tools, text, graphics, the mascot, and branding — is owned by us or our licensors and protected by intellectual-property laws. Subject to these Terms and your payment, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the content you’ve purchased or been given access to, for your own personal, non-commercial use.

You may not:

  • Copy, resell, sublicense, distribute, or publicly share paid content;
  • Share your account or member access with others;
  • Reproduce or create derivative works from our content except as expressly permitted;
  • Remove any copyright or proprietary notices.

7. Acceptable use

You agree not to:

  • Use the Services for any unlawful, harmful, or abusive purpose;
  • Attempt to gain unauthorized access to the Services or other users’ accounts;
  • Interfere with or disrupt the Services or their infrastructure;
  • Scrape, harvest, or misuse data, or use bots to abuse rate limits;
  • Upload malicious code or content that infringes others’ rights.

8. Content you submit

Some tools let you input information to generate a result. You retain ownership of what you submit. You grant us a limited license to process your input solely to provide the Service and return your result, and to operate and improve the Services. Don’t submit content you don’t have the right to share, and please avoid submitting sensitive personal or health details you wouldn’t want processed by third-party tools.

9. Third-party services

The Services rely on third parties (such as Stripe for payments and Amazon Web Services for hosting and authentication) and may link to third-party sites. We’re not responsible for third-party services or content, and your use of them may be governed by their own terms.

10. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that results or outcomes will be achieved. See also the medical disclaimer above.

11. Limitation of liability

To the fullest extent permitted by law, Emotionally Moisturized and its owners and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Emotionally Moisturized and its owners and providers from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Services or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or to protect the Services or other users. You may stop using the Services at any time. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date and, for material changes, provide more prominent notice. Continuing to use the Services after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the courts located in the State of Illinois, USA, unless applicable law requires otherwise.
